Copyright / DMCA policy

Last updated:

The Keyboardy library is made of community and third-party media. If you hold copyright in something that appears in the app without your permission, this page explains how to have it removed — and how the person who uploaded it responds if the removal was a mistake.

We review every notice within 24 hours of receiving it and email you the outcome. To report offensive content that is not a copyright matter, use the content report page.

Submitting a copyright complaint

Send your notice through the report form, or by email to the designated agent named at the end of this page. To be a valid notification under 17 U.S.C. §512(c)(3)(A) it must contain all six of the following — a notice missing any of them may not be effective:

  1. Your signature, physical or electronic, as the owner of the exclusive right allegedly infringed or as a person authorised to act on that owner’s behalf.
  2. Identification of the copyrighted work you claim has been infringed. Where one notice covers several works in one place, a representative list of them is enough.
  3. Identification of the material claimed to be infringing and to be removed, with information reasonably sufficient for us to locate it inside Keyboardy: where it appears, and the clip or sticker ID if one is visible to you.
  4. Information reasonably sufficient for us to contact you: an address, a telephone number, and an email address if one is available.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and — under penalty of perjury — that you are the owner of the exclusive right allegedly infringed or are authorised to act on that owner’s behalf.

Under §512(f), anyone who knowingly materially misrepresents that material is infringing is liable for the damages that misrepresentation causes, including costs and attorneys’ fees.

Handling repeat infringement

We operate a published policy providing for the termination, in appropriate circumstances, of accounts that repeatedly infringe copyright. §512(i) requires a service provider to adopt, reasonably implement and inform its users of exactly such a policy.

  1. Every valid notice is recorded against the account that uploaded the material.
  2. An account that does this repeatedly loses the ability to contribute new content and, in appropriate circumstances, is terminated.
  3. A notice that falls away after a successful counter-notice, or that the complainant withdraws, is not counted towards repeat infringement.

Filing a counter-notice

If material you uploaded was removed and you believe the removal was a mistake, or the result of misidentifying the material, you may send a counter-notice to the designated agent. To be valid under §512(g)(3) it must contain:

  1. Your signature, physical or electronic.
  2. Identification of the material that was removed or disabled, and the location inside Keyboardy at which it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address and telephone number, a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located — or, if your address is outside the United States, any judicial district in which Keyboardy may be found — and that you will accept service of process from the complainant or that person’s agent.

We forward a copy of your counter-notice, including the details you give in it, to the original complainant. The law requires this, so do not file one unless you are prepared for it.

Reinstating content

When a valid counter-notice reaches us, we forward a copy to the complainant and tell them the material will be restored in ten business days.

  1. Unless the complainant tells us, within ten business days of that notice, that they have filed an action seeking a court order to restrain the activity complained of, we restore the material.
  2. Restoration happens not less than ten and not more than fourteen business days after we receive the counter-notice.
  3. If they do tell us within that window that an action has been filed, the material stays down until the matter is resolved.

Jurisdiction acknowledgment

By §512(g)(3)(D), a counter-notice carries an express consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located. If your address is outside the United States, you consent instead to the jurisdiction of any judicial district in which Keyboardy may be found. You also agree to accept service of process from the person who filed the complaint, or from that person’s agent. A counter-notice that does not carry this acknowledgment cannot be accepted.

DMCA safe harbour

Keyboardy is a service provider within the meaning of §512 of the Digital Millennium Copyright Act. The library is drawn from community submissions and third-party sources, and not every file can be reviewed in advance. We therefore operate notice-and-takedown: on receiving a valid notice we expeditiously remove the material or disable access to it, and inform whoever uploaded it. Nothing on this page waives any right or defence available to us or to our users.

Designated agent

Copyright notices and counter-notices go to the agent designated to receive them:

Legal entity
BeInMedia Kuwait for Designing and Management of Websites WLL
Postal address
Salem Al Mubarak St, Block 4, Sahab Tower, 12th Floor, beside Al Layla Gallery, Salmiya, Kuwait

The quickest way to file a complete notice is the report form: it asks for every element the law requires, so nothing arrives missing.
